I believe there's a policy in the FCRA that a creditor can only contact a 3rd party one time to figure out one's whereabouts. However my mom has received 3 calls in the past week from one of them through her houseline (where I used to live) asking about me. Is this in any sort of violation? They have my cell phone number too which is my primary line. The only issue though is that mailing address they have though is my home address, so would this still be in violation if that's the case?

How else can i find if a collector renewd a judgement. so far all records appear to be NOT. it was given judgement in 5/8/03 for an old cc (cap one) debt i was ill and could not make that court date so they got default judgement the of course bloomed in the amount. now 5/12 i receive a new paper from court on the non-wage garnishment and exemption form and debtor request for hearing form. i believe i only have 10 days to request hearing but i don't know how long after it has expired that they can renew it or if I can now file that it has expired and they need to leave me alone.

I just received news an award was made in favor of the bank. No surprise. I really hate them. I made countless trips to the post office sending all of my documents to the forum with a sliver of hope things would work in my favor. I just received the letter from the NAF stating the award is for the claimant. I'm on the verge of tears. I'm on unemployment (actively looking for work) and can't risk having my accounts frozen. Times have been so hard since I've been laid off. I want to scream. I don't want my wages garnished. Are there any options for me?

I have two PDL's that have both gone into collections. One has tried to reach me through my HR department today. What can I do to get them off my back, and not involve my employer? They have both debited my account to the point it is in the negative. I opened another account a while back and had my payroll deposited into the new account, so there is no money in the account they keep sending the ACH debits to. Please give me any advice you can. I simply don't have funds to pay them right now.

I am not an attorney, but my question is regarding my firm operating with an escrow account. If we charge a client $2,000 for services and place this in an escrow account and do not take the money until our services are completed for the client, is this considered an "up front fee"?

I sent 2 separate collection companies offer letters to settle 2 different accounts. I have them 30 days to review and respond and I heard nothing. What should I do now? (PS: I already received validation from them)

This was a recent post in the news group alt.bankruptcy. The OP in the thread had $14K in bank accounts that he thought would be protected as part of California's $21K wildcard exemption when filing a Ch. 7 BK. To his horror, the bank froze the accounts, even though he didn't have a debt with that bank. Apparently this is becoming a common practice.

There used to be a feature on this site that allowed you to record phone calls. I don't see this any more; is it no longer available? Thanks!
