I am close to filing my Chapter 7 my attorney advised me that I will most likely be served that a creditor is in dispute. What section of my local court house do I serch for to see if this has been done? It is Bank of America they say the have evidence of certain things which we can back up that this is all false. My attorney said they proposed a settlement but he says it is just a scare attempt to get money. He said if they feel they have all this eveidence why would they settle for .10 cents on a dollar. What are your feelings on this and has this practice been used on others?

Does the statue of limitations apply to the state you were living in when the debt was created or where you are currently living? I've been in Florida for a year and a half and they have a 4 or 5 year SOL whereas Rhode Island , where I was living has a 10 year SOL

Hi- I just obtained my credit report for this year..and I have some questions 1) I have several accounts listed under "negative or adverse accounts" but the balance says zero, and past due says zero. Pay status: paid or paying as agreed I don't understand...why is it still under the negative section if I've paid it off or have a zero balance? 2) I paid an old debt through a collection agency, and it still shows up as negative! It won't be removed for another 4 years! The amount is only 120 dollars and I paid that already.

Hi - wondering if anyone has any ideas on this one - Had set up a payment plan with Chase at end of last year for auto withdrawl from an account that I don't use (was planning to only put in what they could take out). After a couple of payments I called them because I needed more time that particular month. They said absolutely not and that our agreement was over.
