My car was repoed last night - I was told I could file Chpt 13 and possibly get it back. Is this true

Hi Guys, A few weeks back I posted that I spoke with the Attorney's for Cap1 and reached a payment agreement. They sent me a Stipulation and Consent to Judgment Letter to sign and return. It lists all the payment details but the last line of the letter states, "and consents to the entry of a Final Judgment of these amounts." I just want to make sure I'm not screwing myself or something by signing this. Please advise. Thanks!!

Does the statue of limitations start when the account goes to collections? or when the last payment was made? I have a debt collector that is a lawyer that buys up old debts and is making me pay I pulled my credit report and he has made it seem that a debt has been reported on it shows the last activity from 2003 but under it says it was reported on in 2008 after I paid him for a different debt. Is this alright for him to do?

It seems as though I am in a situation somewhat similar to you in that your debt was related to a business (my biz is still operating, barely). Do you mind sharing what debt settlement company you are using? Also, if you had any CC that were in biz name and were personally guaranteed by you, could you share how these are handled thru debt settlement since they do not appear on personal credit? I appreciate it!

I have been dealing with this company for almost 3 yrs now, they stated that a loan was taken out, put into a savings acct...i have faxed over the letter from the bank stating there was no deposit ever made into this account. They have repeatedly called and emailed me...since this i have opened 3 other bank accounts and they have accessed all 3 and put me totalling over $3000 in debt cause i refuse to pay the overdrafts for bank accounts they dont have authorization for. Again recently that have tried contacting me, and ive faxed them the same letter showing it was never deposited.

Can they really do this??? I'm trying to save money for a lawyer before filing BK and have been avoiding collection calls in the mean time. Now that they are bugging my parents, who I do not want to know I'm in so deep, I need to do something. If a pay an attorney a retainer, will they continue calling or can I refer them to my attorney? How long does it normally take once it goes to collections, before they will file suit? This is becoming far too stressful.

Help, can you tell me how much luck do individuals usually have appealing a wage garnishment? I am dealing with a CA and when they did my financial statement I had $32.00 left over. They demanded $235 or garnishment. I told them there was no way they went down to $225. I offered $100 til I could get another job they said to bad we are going to send out the garnishment paperwork.

I am trying to type of my letters to stop the ACH draft. I know on one of the threads/posts there is an example of wording to use if you want the payments already paid to be considered paid in full and a refund of any overpayments made given back to you. I need help in making sure I word it correctly to get the best results and I couldn't locate that thread/post. I know there are several people who have had success in getting refund and would like to have any suggestions. Thanks!
