Hi - My husband and I have been having financial problems for over a year now. Last year I signed up with a credit counseling Service and had them lower my interest rates and I paid them one lump sum each month that they sent to all of my creditors (Oh and by the way, my main reason for signing up for a company like that was all the advertisements I saw stated "Reduce your monthly payments and interst rates". Well they did reduce my interest rates, but my monthly payment was only $50 less than what I was paying.

 

Insolvent? One or both?

Okay if one spouse does debt settlement because they are "insolvent" how does that work if you get the c1099 or whatever it is from the CC company? If the couple files taxes together, can one be insolvent if together they may not be? Does the form for that include both people's income or just the one who is doing DS? I hope that makes sense.

Has anyone gone this route? Were the lawyers fees equal to, less than or more than the 15% of the debt to be settled that debt settlement companies charge?

I have a credit card for 67k i've been making payments and never late but because i have been using the same card for cash advances and taking from my 401k and pension but i dont have any more available cash what should i do?

Do u have to close your bank accts before contacting them about PID loans? Just asking ?'s about over paying and discussing it further with them? What do you suggest? Thanks

 

Need payday loan help please

I wish i had seen this website before i made the mistake of taking out payday loans.I have taken some advice off this website, by freezing my bank account.I'm not sure what to do next.my payday loans have wiped out my bank account. I honestly thought i could handle them.I'm not sure what to do.It's going to take me a couple checks just to get caught up on the bills that haven't been paid.Can someone here help me please?I live in Oklahoma.These are the loans I have.

First, I am so happy I found this forum! I have been reading your information and as a newbie am just not sure what to do about my current mess. Capital Management Services has been calling my parents, siblings, husbands' ex wife and now my husband regarding a Citibank debt that they have taken over. I paid Capital for 6 months through a payment plan but due to the fact my husband is now unemployed, I am simply unable to pay any further. We're close to losing our house and every penny that I earn goes to paying the mortgage. Believe me, I want to pay them just to get them off my back.

 

How to handle PRA after failed DV and runaround?

On June 08, portfolio recovery associates sent me a letter threatening to sue me on a debt if I did not pay them in 10 days. So I sent them a DV letter. This debt is past the sol. On July 08, they responded with a weak DV letter. They basically wrote on their own letterhead that "Yes, I owe" them. So I sent them a second DV letter pointing out that they needed to show me proof from the original creditor as per Filed vs Wiber. I also told them that they had to stop reporting the debt to the CRA's since I was disputing it as per the FCRA.

I had read before that your credit score suffers when there are balances that are above 80% of the available limit. We have about 25K in savings right now. If we use it, we'd pay off the remaining balances on our car loans (6K total) leaving us with another 19K. Is it better to take that money to pay off a card or two OR would it be better to spread that money out and bring each card below 80% of the credit limit? Does that make sense? If I pay off two cards, I still have two that are maxed out. So I am unsure as to what the best plan of attack should be.
