Legal or illegal?

17 years 9 months ago
I have about 7 payday loans, 3 of them are just fine, but 4 of them are horrible. I have been paying the fees on them over and over, which Arizona law says that legally they are only allowed to roll over the loan a total of 3 times. I have paid these loans back. I closed my account, but I am worried about the phone calls and legal actions. I want to pay them back but I feel I already have with all the fees I have paid. Here are the loans Big--loan amount $200. I have paid fees since March 2008, started at $80 ever pay check but lowered every month until it was $40.

Is HELOC discharged in Chap 13?

17 years 9 months ago
I'm hoping to file chap 13 to keep m y home. My 1st mortgage is $390 and Heloc is $120. This with utilities and car is about 80% of my income so there won't be much left for creditors. I've read tha Heloc will be discharged after the 5 year plan is up. Is this true?

GENEVA ROTH TRYING TO COLLECT 3X THE LOAN VALUE

17 years 9 months ago
I got into financial trouble, borrowed $400 from Geneva Roth, and after two $120 'interest' payments I stopped payment on them. I had more than one loan at a time (dumb, I know), and I could not continue to pay the payday loan companies and still pay my rent and other bills. As others have said, I have been able to work out agreements with the 2 other companies, but Geneva Roth is apparently out to get every penny they can from people who can't afford it. The first time I called them I was told that I wasn't in Collections yet, even though they had tried several times to take money out.

This is bugging me

OK, I need to hash this one out. Recently, a person from California posted on the boards to get help with their PDL problem. Although the legal limit for a PDL in Cali is $300, they got loans for over that amount. Both Shazzers and I told her to payback what she borrowed and stuff the rest, which is what I believe is right and what I did myself with my own PDL mess.

Texas PDL HELL!

17 years 9 months ago
I am in some big trouble. I have three pay day loans to the tune of $900 in service fees a month and I can no longer afford to keep paying them. My only option is to close my checking account and let the defaulted loans go on my credit report. A friend of mine told me he had to do the same thing a few years back. I am stuck in the constant circle of payday loan hell. Over the past 3 months I have shelled out over $2700 in service fees alone. I really need some advice on this issue.

Does anyone know?

Does the template letter that I wrote so long ago work anymore? Has anyone had any success with it as of late? Has anyone had any PIF's or anyone got any refunds lately?

If I closed my bank account and opened a new one with the same bank. Can the PDL companies debit my new account even though I have NEVER given the account #?

Recieved a summons with no court date?

17 years 9 months ago
I received a summons from Frederick J Hannah c/o Asset Acceptance for a debt that was charged off in 2005. I know this is my debt. The problem is what I have heard about these people. The summons did not have a court date. I have not answered, as I do not know how, but I have only 15 days left to answer. Any help would be greatly appreciated. Also I am the only income in a 5 person household(spouse,3 children). Spouse can not work due to youngest child (19 months) has trouble swallowing and goes to the doctor for treatments and checkups 2 to 3 times a week. Thanks
