Advice on how to handle a lifes worth of financial mistakes

17 years 9 months ago
I'm 25, go to college full time and work part time. I have over 20k in debt. I've talked with a lawyer about bankruptcy and a credit counselor. The bankruptcy lawyer says that if I file bankruptcy that I'll be financially free and I'll be able to build up good credit quickly and get my life on track. The credit counselor says that he can wipe some debt off my credit and I'll still owe the people, but it won't be on my credit, and then he can help me get good credit going again. So, which ones right? Or are neither?

summons I never received..how to proceed?

17 years 9 months ago
I live in Minnesota. Today I received a letter from a law firm representing a credit card, the letter is a request for a hearing for them to be awarded attorneys fees. Apparently they served a summons and since I never responded it says I defaulted and they won the action against me. I never received the original summons. I haven't lived at the address they have for over a year. However I do still own the address and am renting the property but the renters said that nothing was ever delivered there. I don't know what to do at this point. How do I prove that I never received the summons?

FDRS scarmbling to find lawyers at NACA!

17 years 9 months ago
Word has it that FDRS doesn't really have a network of lawyers, instead he is frantically trying to find lawyers through NACA to take his customers...lol. Hey FDRS you shouldn't lie to your customers! This FDRS group sounds like a bunch of pikers who shakedown their customers for 22% of their outstanding debt, throws a few dispute letters around and then doesn't have the lawyers they promised!

1099-c and debt collection

17 years 9 months ago
A collection agency seized my bank account this week to settle a claim. I have two separate 1099-c forms showing the debt was cancelled in 2006. When I contacted the CA, they informed me that they have guidance that they may collect on the debt, even when it has been canceled. I live in Texas. I can't find anything on the web to corroborate his claim. I need help! Thanks, Marty

Is ACH trying to collect after you payoff loan?

17 years 9 months ago
I see all of these posts concerning a company Pay Day Trans or Achloan.com that sent payday loans unauthorized. I had to hunt them down through my bank and got to the website. Are they still trying to collect after you agree to payoff the whole amount? I let it go one payday and then paid it off, are they going to still come after me for more? Or did you other people not ever try to pay the whole amount off?

Title Loan

17 years 9 months ago
This site is great and very information, but I didn't seem to find that much info on Title loans, so I hope someone can help me. I have a title loan. The interest payments were supposed to be monthly (i assumed), but actually are every 2 weeks. I live in IL and have filed a complaint with the IL AG Office, and am waiting to hear back. My main concern is not losing my car as it seems these people are snakes. Heres the story I had some payday loans which I paid off. After paying them off, I closed my bank account and opened new one to avoid any unwanted deposits or debits.
