I got sued and managed to ask them to settle out of court and they accepted. They informed me that my total was 4250 (even though the court document was for 3709) and I asked if they would accept 3300 (as that was their settlement offer for court) in 7 months time. They didn't even argue- they accepted it immediately. I'm wondering if I went in too high... or since they're suddenly changing the amount if that's considered a violation of some kind. They're misrepresenting the debt... I'm not sure how it all works.

I thought of this driving to work today. If I close my Amex account, will my interest still keep collecting? According to Amex, late fees/overlimit fees will continue to accrue (I guess until it goes into collections??). If I close it, may I still make payment? Is it really bad to close an account that is not yet paid?

A few months ago I got a letter from an attorney's office regarding a clothing store credit card. I have been making monthly payments to them but I just realized that I havent made July's payment yet. I am curious what would happen if I mailed a payment today but they dont receive it until next week. Can they do anything like garnish my wages because they dont have a payment for July yet? Does an attorney have more power then a CA? I am concerned.....Thanks!

Okay, I know I can't make my minimum payment to Amex this month so basically will be defaulting and waiting for collections. I hope collections will work with me on a payment plan. My question is: should I keep sending Amex something each month even though it won't be the whole payment they want? Would that "look" better? I figured it would at least look like I'm not blowing them off completely. Also, once an account is in collections, do the late fees/overlimit fees stop?

I have a debt (valid from Citibank) that's been in collection and have received a summons for a court date. Its set for next week and I want a continuance. Are these usually granted as a matter of right the first time its asked or is the court going to be problematic? I want to ask for a continuance to request additional time to find a full time job (I've been looking for months) and can set up a debt consolidation of this and other debts. Is this feasible? Will the court be amenable and is the reason (which is completely true) one that the court will understand?

My wife and I have agreed that we need to get our debt paid off as soon as possible. We made it, we need to take care of it. Why are the credit companies not willing to help you until you've reached a point where you're behind? Are there creditors that will work with you instead of forcing you to go delinquent in order to get any help? Thanks in advance...

I hope someone can help me. I have a civil suit against me from Capital One (valid debt). The suit went to judgment and I had made payment arrangements with their legal representative to make payments ($25.00) a week. My husband is the only one with income, so when his work slowed down, I missed three payments. I called them to let them know of my situation and said I would send a payment as soon as I had funds available. The rep. said she would note the account but that I was breaking my commitment.

what has your experience been with American Express collections? Are they willing to accept payment plans without being too nasty?
