CA telephone contact after DV Letter, what can I do?

Hi everyone, This website has been very helpful to me as I try to deal with a CA, I really appreciate everyone's help and comments. Now, onto my question. I sent a CA the DV letter and included the statement "I would also like to request, in writing, that your offices make no telephone contact to my home, to my place of employment, to my cell phone, to my previous phone numbers, to my relatives or to anyone in my community.

LVNV Funding was not formed until the day of April 13th, 2005 in the state of Delaware. They put on my 3 credit reports that they opened an account with me on 5/2005. Not one month from the date they opened their business. The problem is that they have a South Carolina address listed on my credit report. They didn't open in SC until September 12th, 2006. Another problem I see is in my state, they owned the account in 05/2005 not even a month after they opened up shop. They did not register with my state as a foreign entity until September 15th, 2006 at 5:32pm.

 

Violations by debt collectors

I was doing some reading and a lot of states require that a CA must be licensed to collect debt. If they are not licensed to collect and contact you, that is a violation of the fdcpa and your own states collection laws if you have any. It also holds true that if you call them and they talk to you over the phone, the same applies. They must tell you on the phone they are not licensed in your state and they must hang up the phone.

Hi, My name is Jordan. I'm a part time working student in WA. I need help with my pdls. I have one out with 4 different places all store front. Check Masters $300(loan amount) Advance America $300 Money Place $100 and Check into Cash $50(that one isn't in default and can still be covered though) Due to some slow work I'm completely screwed on the mind boggling check juggling I had been doing just to stay afloat. I havn't done enough rollovers to opt into a formal payment plan with any of them. Adv Am. will be due today (May 24th)and the other 3 on the following paycheck.

 

Working student got caught in the cycle

I took out my first payday loan about 4 months ago which like nothing turned into 5 different places taking at least 25% of my check a month. And now I want to end it and never even look at a pdl place again. Devils I say!

I received a phone call from a guy from this company today which I haven't heard from since December. I had sent them an e-mail requesting PIF and that they make all contact through either e-mail or postal mail only, they are not to call me at work or at home. They have continued to call me over the past couple of weeks. Today I told the guy again not to call me at work or at home and that their company is illegal. He said that they don't have to follow the laws in my state, only the UK laws and that I signed the contract knowing that.

 

repo garnishment?

my car is about to get voluntarily reposessed, not b/c i can't afford it, but b/c im tired and broke of living paycheck to paycheck for repairs, there were lots of problems that werent found till a month after i bought it. besides i have a paid off vehicle, for transportation. so if i refuse to pay the balance aftyer auction whats the probability they will garnish my wages? afterall we are in a recession and repos are at an alltime high? i can pay the balance, just really don't want to, ive paid so much for this already, it disgusts me

 

Midland Funding,LLC Need advice please

I thought that when I hit submit it went but guess not. I guess when it rains it pours as today in the mail I receive a letter from Mapother & Mapother, P.S.C. dated April 24, 2008. In it they state and I quote, " At this time, no attorney with this firm has personally reviewed the particular circumstances of your account but may consider remedies to recover the balance due if you fail to contact this office". It goes on to say that I have 30 days or receipt of the notice. By my calculations, my 30 days are up AFTER tomorrow. Am I correct?

 

A "law office" collecting money for a PDL?

We received a call from an "attorney's" office for a PDL that we took out. The girl's name was Amber. I don't recall the "attorney's" name. She was very nice and I knew that we had taken out the loan and she informed me that she was the "last" step before "litigation". I set up a "good faith" payment of $250 for the following Friday. When someone else told me that I shouldn't let them take anything out of our account without something in writing, I decided to stop the payment and investigate a little further.

I guess when it rains it pours. I received today a letter from Mapother and Mapother,P.S.C. who states they are representing Midland Funding. This is dated April 24, 2008 and I received it TODAY in the mail. I have my debt validation letter ready to go in tomorrows mail via certified return receipt. My question is this : In this letter they state that no attorney has "personally reviewed the particular circumstances of your account" and if I dispute the validity that I have 30 days to do so. By my calculations, AFTER tomorrow the 30 days are up. Am I I correct in my understanding?
