Has anyone ever tried to sue an ipdl in small claims court for a refund? I am just wondering about it. It seems if you had all the documentation including your state's laws, you would win, and possibly by default, since I bet they wouldn't even show up. In small claims court, you would not even have to hire a lawyer.

What happens if you get a court summon? Can you still go the the creditor to work out a payment plan? Thus avoiding court and a judgment? Thanks,

My creditors called me at work and they spoke to the wrong person, and told him that he is behind on his account which was my account information. is this a violation? if it is what kind? Can I file some sort of complaint against them, since my information was shared to someone else which was not supposed to happen?

Woohoo! I just got an e-mail from Impact Cash informing me that, in response to my letter stating the state laws, my account is marked PIF! They stated they consulted their "legal counsel" and they are a legal company (yeah right!) but they will want me to be a satisfied customer, so they are marking it PIF. This is my third one! I have had an accounts with MBNA for several years, it was sold to BOA. I owed approximately $7000 and called BOA in July because I saw an opportunity to do a unsecured loan - they talked me into $50,000 - they added $1500 in fees they didn't disclose and increased my line to $53,000 and paid off the credit card and lowered my limit on it. So now I have two accounts with BOA - totaling $58000 at this point - payments are huge and I used the money to pay off other cards. Am I a candidate for debt settlement?
