This Internet company is trying to Garnish my wages for this Internet loan company they will not make arrangements. Help can they do this to me??? :cry: Keshia

I have had Riscuity call twice trying to collect on a payday loan from Zipcash. They will not identify themselves from the outset and try to act all chummy and friendly. After continued asking, "Who are you?" they finally breakdown and tell me who they are. They also would not give me an address where I could send a DV or for that manner, any information at all. I just received this email from capital collections. Quote:

We require your bankruptcy case information otherwise we will proceed with legal actions against you. We have the possibility of placing an incarceration order and also lawsuits in order to collect the money that you owe to my client.

What is an incarceration order?

So I'm filing chapter 7 bk, I should file the paperwork at the end of march. I was going to hire an attorney, actually I did hire an attorney, paid him over $600 in three months, then realized that at the rate I was going it would take forever before my case would actually be filed ( I had to pay him $1600 before he'd file). So I decided a month ago I'd have a paralegal do the paperwork and I'd file per se. I have no assets so it's a simple case.

My ? is why are they so different?? one company told me it was due to the types of cards I have and they are harder to settle with. One other quick ?...should you be worried if a settlement company ask for a initial starting fee up front?
