Sued twice for same debt

I have a judgement against me from Discover card. This occured back in March 2009. Last week I recieved a summons for the same debt. This time through Mann Bracken. I called discover and the debt is with Mann Bracken. The previous suit was filed through WW&R. At the time they had the debt according to Discover. I need to file an answer next week. What should I do?

Keep checking back for more replies, I just wanted to make you aware of who you're dealing with, Mann Bracken are NOT to be trusted. If you have recently received a letter of collection from them it should state somewhere on that bill-you have 30 days to request validation, if you do not then they will assume the bill is yours. My advice to you is to send out a debt validation letter to Mann Bracken asap, send it certified mail return receipt requested so that you will have proof you did so. Don't wait until the 30 days are up, do it right away. If you need help comprising a debt validation letter just type in "debt validation" into the search box located in the upper right hand corner of this forum. It's VERY important that you request debt validation. The chances are none to slim that Mann Bracken will be able to validate that debt, meanwhile, all collection efforts must stop until they validate the debt. They must prove that it's your debt and that they have a right to collect it.

You aren't so much looking for a letter saying 'we can collect on this account.' You're looking for solid proof that they are who and what they claim to be, and that they have the right to collect this account. Per the FTC, that proof is required to be furnished in the form of documents that establish a chain of authority on the account from the original creditor, through any intermediaries, to the current collection agency.

Read this for additional info on debt validation. Then type 'validation letter' into the search box on this site to find example letters.
