Hey Nelly, good morning, hoping you can help us out with this problem. I live with my parents, I am my parent's son. I also have a sister who does not live with us, she is my parent's daughter. She is incarcerated right now and for the past many months we have been getting collection calls that keep becoming exceedingly more rude and obnoxious. We don't know who it is because it says "out of area" on our caller ID. My mother would keep saying, sorry "she is incarcerated right now" then they started getting belligerent as in "I NEED TO SPEAK TO my sisters name" and being rude to my mother.

It is time to rewrite the sample letters here on the forum. Lets face it...the letters here are utterly ridiculous and are simply bad copies of other stupid letters floating around the internet. Whoever wrote them probably never read the FDCPA and it is embarassing to have to continually tell posters on this forum not to use these pieces of junk. As a former debt collector, I used to laugh when I saw these letters come in....they simply told me that I was dealing with someone who knew how to cut and paste a letter but had no clue on what their real rights were.

Good Evening, I took out a Pay Day Loan in June, 2010 from Advance America in the amount of $500. I couldn't afford it and had to close my account in order to get my finances in order. I know now that Arizona does not offer or will not offer any pay day loans. Will this help me in my favor because AZ passed the law. I am getting calls that they are going to send me to jail, warrant out for my arrest, processing serve the works. I also know that some of them are scam artists but they still are worrisome to me. My question is can I go to jail for this.

Hello, recently i was summoned by a collection agency for an unpaid hospital emergency room visit i made last year and three years ago. i called the agency and set up monthly payment plans, when i asked them if the case was still going to go to court, they said that it was 'just in case i decide not to follow up on my payment plan', i also asked them if i needed to answer the court summons officially and they said that i did not. so i guess my question is should i just continue on and make my monthly payments or should i reply to the summons and go to court?

My question is: what is the date that you use to take a "snapshot" of your finances to determine solvency. Is it the date that you reach an settlement over the phone, the date that is on the letter they mailed, the day of the last payment, the date on the 1099 or something else? I recently reached a settlement with Chase. I have made 2 payments with 2 more to go. I have also started negotiations with BOA. As of right now we are insolvent but if we sell our house we will become solvent (barely).

Ok so the phone calls have started. East side lenders are pretty much ignoring all my emails and keep saying I owe the full amount. They are actually responding by email so I am ignoring their calls. Loan shop said they changed my status to paid in full and that I didn't have to worry about them calling. Technically they owe me 500 but I'm not worried about the refund. Consider it a lesson learned....a very expensive lesson. Here is the thing though...two of the illegal lenders didn't have email. 123wages and payment direct. Payment direct has started calling today. What do I tell them??

I filed chapter 7 sept/2010 it was discharged Jan/2011 . I had a house that was included in bankruptcy we moved out didn't want the house. The sheriff sale/ foreclosure was pushed back several times and still hasn't been foreclosed. Today i received a letter from a lawyer for the mortgage company saying there is a judgment against me filed in my local court for the balance on mortgage plus interest. The letter says about garnishing wages etc.

I received a letter in the mail from Morasse, Collins and Clark threatening a lawsuit over unpaid rent on a property I was evicted from. I had worked with them to negotiate me staying in the property a bit longer in exchange for payments. I emailed the lawyer that I had worked with to negotiate that to see if he would be willing to discuss a settlement of the balance and I received no reply. However, I found out from the county court's database that they have filed suit against myself and my husband.
