i just got served by midland funding 2 weeks ago! I'm being sued for 10,000 dollar credit card debt, what can i do about it, please advised!!!

I line in New Jersey. I am planning to file bankruptcy next month. Me and my wife live separately for the last 2 years. We haven't divorced yet. My wife has refused to file bk with me. So, my question is, can I file bk under this present circumstances? Can I claim her homestead exemption in the house.
My annual income is nearly $50k. I am a bachelor with $98,000 student loan debt. I pay nearly $850 on my student loans. I deposit around $1500 on my checking account every month. I want to lead an organized financial life. This is why I am asking, should I increase my payments on student loan or start saving more money?
After checking my credit report recently, I found that my wife has taken out a new credit card using my confidential information. The card has been opened in my name. I have not applied for the credit card and don't live with my wife. What should I do now?
We are on the verge of bankruptcy but I want to see if there's any way we can avoid it. We had two vehicles repossessed and the balances are around 20,000 and then we have random other debts that are probably 10-20,000. Do you think you could help us? hey all, like many on here i got my self sucked into the evil payday loan cycle and now am paying fees after fees with not to much left after I get paid. Stupid mistake but I can't beat myself up about it. Times got hard with my husband not working and i had no choice!!! I closed my acct as I was thinking about using a consolidation co. but chances are they will be able to withdrawl regardless. What is your advice on sending the below letter to my lenders, and what can they do if I do. I want to pay these off just not the fees and on plans.
