My husband and I received a letter from Recontrust Co. saying we owe the balance on a home that my husbands mother owns. At one point our names were on the DEED with our mother, but NEVER ON THE LOAN. She walked away from the house. Are we liable to BOA, we didn't take out the loan?

I am being sued in civil court for violation of a non-compete and misappropriation of intellectual property. I do not plan to respond to the suit since I cannot afford an attorney and the plaintiff has unlimited resources. If I do not contest the suit and am found liable for x amount of damages, can I turn right around and file for bankruptcy and have the judgement discharged?

My Chapter 13 should pay out in June 2012. I am 6 months ahead on payments. My husband had an anureysm in Octoer 2010. My payments are 1520.00 per month.
