If a debt collector is asking me to pay more than i can afford can they garnish my check if i am sending money in to make an efforded to pay it off

Background: In default on around 90k, all federal. I'm finally at a point where I can make the $800 a month rehabilitation payment, but I probably only have enough saved up to make the payment for about a year. Realistically I'll need to be in IBR repayment within about 10-12 months.

lloyd ward and associates...are they any good? How do I know they are getting it done? I always get returned phone calls. Very nice and polite to me. I just need to know if I need to get out while I can and choose better.

I just received a summons from this JDB called Midland Funding LLC. No notice what so ever, just a summons served to me today. I've been out of work for the last 2 and a 1/2 years because I'm taking care of my Mom who has Dementia and we're living on her small pension and SS. In fact, that was why I went into debt with Cap One which is where this company bought the debt from. It went from a $5,000 debt with them to a $11,839.46 debt with this JDB. I have no money, no property and nothing but a car.

OK, here's the skinny. In another thread, I indicated that I am filing Chapter 7 bankruptcy. My expected timeframe for complete discharge would be early January, depending on my court date, etc. I was also told that my tax refund would likely not be touched at all (yay!), because I would need it for a downpayment on my next car.

I have been dealing with a few issues with my credit and I have been following posts on this forum. Most of them have been resolved due to the DYI on this site. Capital One has been reporting on my credit report a debt that does not belong to me. I had been trying to get debt validation from them for the past few months.

I am being sued by Capital One for credit card debt. I have already filed my answer, etc. I acknowledge that the debt is, in fact, mine. I spoke to the paralegal that is assigned to my account at Morgan and Pottinger today. I told her that I would not be able to just drop the full amount ($5,360), and I would be better off making payments. She said they would accept $175 payments (which I can do), so I agreed.

Try to consolidate and re-pay $20,000 worth of creditors on a $20,000/year salary. It ain't gonna happen, Jack. Re consolidation, watch them soak up your payments in up-front fees, and you're still in the hole. Go to the FTC website for the truth on debt consolidation scams! !
