Getting calls from collection agencies or managment companies?

When should I expect these calls to come in? I'm reading horror stories of these people trying to collect their money. Do these calls start after the original creditor charges off your account? Thanks

I hope someone can give me some advice. I was set up in a payment arrangement with the IRS and got layed off a month ago:(. I owe about $7,000.00 (yuck I know), and do expect when I file my 2009 taxes I will get a refund which will make the balance lower. On Friday, I got a registered card in the mailbox, which I know is letters on my default. Do you think if I tell them my situation they will work with me? Thanks

So last year (2009) I sent email after email to oneclickcash stating that the loan was PIF secondary to them being illegal and no response and now out of nowhere I start receiving calls that it is imperative that I log into recovery dot oneclickcash dot com to "resolve" this issue. Truly the only issue is WHERE IS MY REFUND? Guess it's back to letter writing time.

 

Advantages of hiring a debt settlement company?

What are the advantages of using a debt settlement company? I have no experience in trying to settle my own debt and other than the fact a settlement company will do all the talking for me, do the advantages out-weigh the disadvantages? I’m assuming if I hire a company, I won’t have to do any work and just agree to terms.

Is there anyone out there currently dealing with CMS / Integrity Debt Solutions? Here is where I am - these are the facts: I signed up with CMS based on the information sent by the rep. that stated the following; 1/ they never get sued AND if I should get sued they would handle all of the legal issues including getting the venue changed so THEY could handle it in court if need be. 2/ the fee of $2500 covered the cost of the credit repair. Well here I sit 2 years later.

Hello, I have a bunch of these dang things. Had major financial issues due to the economy and turned to these for a "quick" breath of fresh air until I could get my situation under control. Well, it resulted in multiple as my situation actually worsened. I live in Arizona and I am scared to death. I was able to close my account successfully and they are all starting get the rejected ACH transactions/debits in the next few days. I feel better about my possition but I am worried about calls at work, etc. Not sure where to turn or what to do. I'm so happy I found this site!!!!

Suing on a time barred debt is illegal

It IS also a violation of the FDCPA. Here are a few cases that discuss this. It is also against state law as well not to mention Frivolous litigation. If they file a lawsuit knowing full well it can't be filed, knowing the debt is time barred but they file a lawsuit anyway. it is frivolous. I have heard one person on here state it is not a violation of the FDCPA when it clearly states they cannot take action that connot legally be taken and also it is false, deceptive, or misleading. Kimber v. Fed. Fin. Corp., 668 F. Supp. 1480 (M.D. Ala. 1987) Shorty v. Capital One Bank, 90 F. Supp.

 

Debt Validation Account Number

Hello, I'm about to send off a debt validation letter tomorrow and have some concerns. Of course, if they are unable to verify the debt, I am pretty much in the clear, according to what I've been reading. In the sample debt validation letter, it had an account number. Now, I have an account number, but what if I were to leave it out? Would it make any difference or make my letter null/void? I'd like to do this to make it even harder for them to validate the debt (there are lazy people out there). If anyone has this information, that would be great. Thanks!
