Payday loan turning into warrant for arrest?

I had a payday loan with Cash Now in Desoto Texas. I was making interest payments on it until I couldn't do it anymore. It's a storefront and each time I made a payment I had to write a check for them to keep. I got a letter from the Criminal District Attorney saying a criminal complaint has been filed against me for the offense of theft by check/issuance of a bad check and I could have a warrant for my arrest. Is this possible? There was no theft. I had been making payments. What do I do?

Well I have been given a clean bill of health (more or less) with only minor, controllable problems. I have decided to do something more with my life and honestly? All of you here and what I have learned here and in my research has helped me to decide on this course of action. I am going back to school! There is a lack of consumer attorneys in the Texas panhandle who are also up on the debt collection laws. (I knew more then one consumer attorney I called once). So I decided to study to become a consumer attorney.

 

Suing CA's

I was curious about something and wondered if anyone could shed light on this. Now Texas has some nifty laws that allows people to sue CA's for breaking Texas codes. What I was wondering if while you are suing for the Texas laws broke can you also sue for the federal laws broke in the same suit? I just would be tickled pink if you could sue for Texas statute damages along with FDCPA and FCRA damages as well. :twisted:

 

Need Advice about SOL

I had a collection agency attempt to get a judgment against me for a past debt. I was served the summons, answered the summons, etc. I did everything I was supposed to do. In the affirmative defenses section in the summons answer, I made note that the SOL had expired on the debt. Needless to say, the CA continued their case against me and overlooked that fact. Fortunately for me, Mann Bracken was representing the CA so the case was dismissed. However it was dismissed without prejudice, so there'a s chance the CA can attempt to collect again.

 

Late on Chase CC, can they withdrawal from my checking?

On another thread somebody said that Chase credit card starting collecting (unauthorized) money out of their checking acct after 90 days late. They had almost a $0 balance but with the overdraft Chase Visa was able to extract $700 to pay the bill. Is this legal? I pay my chase visa with a direct deposit so they know my account. I wonder if there was some sneaky fine print in the agreement saying they could do this.

 

Another card paid off

Capitol One charged off one of my cards at $1900 but after interest and everything it ended up ballooning to $3600. CA properly validated and my attourney told me that even though Capitol One charged off, they still owned the account and still charged interest. Well I ended up settling for $1500, way lower then my lawyer thought they would accept! Happy to get another monkey off my back!

 

Financial aid question

I'm taking classes online at a college. Got financial aid and everything. Well yesterday I got an email from my financial aid advisor telling me that they screwed up and put me in the system as a commuter and not an online student. Because of that my aid should have been lower. I can understand that I should have not been awarded so much because of my status. But now because of THEIR mistake, I end up owing money which I don't have and will now have to come up with $1000 or I won't be able to register for next year. Is this something they can do because of THEIR mistake?

 

In way over my head in payday loan debt!!!

:(i have 5 outstanding INTERNET payday loans totaling almost 2,000 - with the following - Ameriloan, OneClickCash, e-payday-loan.com, Husk Hawk Mktg & Nationwide Cash - i have closed my bank account but not after accumulating over $3,000 worth of overdraft fees because even though I wrote to all of them that I have closed the account - they all tried to get their money - What are the laws in NC? I have read somewhere that it is illegal to give ME a payday loan in NC - is this true? Am I obligated to pay these people back? I need help - I am truly burying myself in debt...

 

How long do they continue to call.

I had several pay day loans well over a year ago. How long will they continue to attempt to collect before they give up, or do they not ever give up. I got a call today, I didn't answer, checked the number and it was an international collection agency, obviously not licensed in Minnesota. Just curious, do they give up?
