Last Dec 08, i stupidly filled out an online loan app for some cash. Cashnetusa approved me for a little over 300$...well i couldnt keep up payments which resulted in dozens of overdraft fees before i closed my bank account all together. Now i havent made a payment since im broke in over 8 mo and ive been avoiding collection calls. i should resolve the debt since i did recieve the money but now a law firm collection agency is calling me everyday and i recieved a letter stating i owe $1350. A thousand dollars in fees and penalties seems ridiculous.

I have received an email from Capital one stating to log onto the website for payment solutions. Has anyone else received this? I have one account in good standing but another one that is severely past due now. After numerous phone calls, I am at a loss for what to do with my past due balance. I am so tempted to check out this email, but I am not sure if it is just a phishing scam. Anyone else get this? Want to make payments and see if you have special offers without picking up the phone?

Hey, I just got a letter from Wells Fargo saying: Dear ______: Due to the serious delinquency on your accoung, we are notifying you that your entire balance of $8,766 is due immediately.

I wrote out my whole story, then decided against posting it. Reading it just made me feel defeated, and kind of humiliated...I hate feeling like there's a bounty on my head. My question is, do collection agencies consider a person's assets when they decide whether or not to sue? For example, if a person doesn't own a car, or property or have any cash (unemployed)...would little potential of recovering the debt or legal fees be a factor in deterring a lawsuit? I'm currently reviewing the papers sent to me from the court about my upcoming mediation scheduled for 8/24, in the disclosure statement on the document it states: The Arizona Rules of Civil Procedure require that each party share with the other party all information known or available convering this case. Please refer to Rule 26.1(b)(1), ARCP for more specific information concerning disclosure. This DISCLOSURE STATEMENT provides a format for you to make such disclosure. This DISCLOSURE STATEMENT must be completed and exchanged with all parties within 40 days of the filing of the ANSWER.

Just wondering if anyone has any experience recently with any debt settlement companies. We are currently about 45,000 in debt and need some relief. Trying to avoid bankruptcy if possible. Any advice would be greatly appreciated!!

My husband and I have 11 (I know that is really bad) payday loans. All of them were done over the Internet. If I send out cease and desist letters to all the companies, do they legally have to not take money out if I request that they don't in writing?

Hello all Hunt and Henriques got a judgement on behalf of CITI. They filed a Writ of execution a week ago. Will they levy my account? Im hoping some one has experience with this. Any help is appreciated. Thanks

Rec'd a note from Cohen, Trauner & Thomas 5-6 weeks ago. Sent back a debt validation request, got the green card back in the mail. Never heard from them. This is the 5th or 6th agency who cannot verify anything when asked; the debt is on behalf of Amex (or CACH depending how you look at it). Any suggestions how to approach Amex and say, "you obviously have nothing, offer me a settlement or go spit." Also, never rec'd anything from them, but LVNV is on my credit report under two other accounts as of May.

I need help!! My wife is trying to be sued by LVNV at this very moment. I sent a debt validation letter on 7/1/09 and they recieved it on 7/6/09. They have not responded to the letter and a process server was just at my front door trying to serve my wife. Do I call the collection company and make arrangments to pay or do I send another letter asking to validate the debt? Not certain what to do. We live in Texas and the SOL is still in effect.
