A CA is suing me for a debt that is past the sol. I plan to counterclaim for $12K in FCDPA/FCRA violations. They are suing in me in my county court. Will I be able to get a judgement for my counterclaim in my county court even though the violation is of a federal law?
I've been asking around. Some people say "no" because you need to sue them in federal court to FDCPA/FCRA claim damages. However, others have said that they have received awards in local courts for violations of the FDCPA/FCRA.
