A CA is suing me for a debt that is past the sol. I plan to counterclaim for $12K in FCDPA/FCRA violations. They are suing in me in my county court. Will I be able to get a judgement for my counterclaim in my county court even though the violation is of a federal law? I've been asking around. Some people say "no" because you need to sue them in federal court to FDCPA/FCRA claim damages. However, others have said that they have received awards in local courts for violations of the FDCPA/FCRA. WHat do you think?

are PDL's legal in NY state

I am trying to find contact information for a payday loan company. Money is being taken out of my checking account, the name in my account pops up as int'l payment svcs (IPS) does anyone have any idea how to contact them I really need to know.

My credit report says SOL is 7 yrs, but my old credit card debt is from MN (6 years), and I now live in CA (4yrs), so which amount of time is it legal for these items to remain on my report? Also, what date does it start from? The date they closed the account, the date they sold it to collection, the date each collection agency passed it to another one, or the date the account was opened? Thanks.

I received what look like legal documents from CACH, LLC. The bottom of the forms read CASE MANAGEMENT STATEMENT. There is a conference time and date noted on the form. Is this an order for me to appear? No where on here does it say who the money was owed to? I paid off all my debt (some of it was settled for a smaller amt) in 2004. I've received no letters or calls, this is out of the blue. On one page it says no trial date has been set, yet below that it asks which dates parties or attorney's are unavailabe, and give a reason why.

I am the logo designer 3 months before my company shutdown and I am unemployment for alst three month. I am not able to pay my personal loan debt installment. Bank person are knocking me everyday but now they are thretning If I don't pay the installment then they will sent anti social people to take the money form me. I am very helpless now and I don't know what to do. Please help me out how I will be able to get out of this problem. Currently I am in search of job. But I don't know when I will get the new job.

ok back in july. I got sued my lvnv. My lawyer when to court and they couldn't provid any information. (I'm think I paid this debt a long time ago) So the they asked for dismiss. The judge and lawyer sent me a dismiss letter without rejudice. Ok well yesterday i got a letter in the mail from notherngroup saying that lvnv sold them the account and they are demanding money. i can't call my lawyer until tommorrow What is my next step? I'm in missouri
