Did the collection agency violate the Fair Debt Collection??

I had lived with my mother until about 5 months ago, and the other day she was handed a summons for me to appear in small claims court. attached to the summons was the complaint, which indicated the amount of my debt and that it was an attempt to collect a debt, etc. etc. Doesn't this violate the FDCA? This summons was in no type of envelope whatsoever, and it plainly indicated to my mother (that was embarrasing enough) that they were looking to collect money from me. does the FDCA apply to a summons? Should I settle with these people or go to court with a counterclaim?

As a young soldier I had a lot of money coming in and few bills to pay. That quickly changed as I "grew up," bought my first house, and a new car. After about living in the house for a year I had to move, as I had finished my military career, and had taken a large paycut in the process. I had to take out some loans and get a couple of credit cards to help "fix-up" the house to help it appreciate for a little more, plus help with moving expenses. When I arrived in WA the jobs were few, and the house did not sell, so deeper into debt I plunged, trying to cover my expensise here and there.

I'm being sued by these people through a lawfirm of course, and the lawfirm won't give me the phone number for JD Consumer One, and I can't find anything on Google. Anyone?

I am one of the many that ran into the payday loan trap...but here's something I can smile about... I opened my email and saw that my spam folder had emails from other payday loan companies offereing thousands in an hour ~ I just smiled and deleted them. Never again :)

 

Allied Interstate trying to collect debt already paid off

A department store mistakenly charged a pair of pants to an inactive account. Since we had moved a year and a half before and I pay the bills, the bill was never forwarded and my wife did not catch the mistake. When we were buying our house this past summer, a delinquent account came up on her credit history. We called the store's credit department, and after a very very very frustrating series of calls over the course of SIX MONTHS we were finally able to track down the agency with the debt. We paid the agency, with a 20% break on the debt (now about 5x the original charge).

Back in February of 2006, I was virtually debt free. The only "debt" I had to my name was my car loan, however, I was keeping up with it, and it wasn't a bad debt. My former boss was also a landlord. When he had an apartment open up, he offered it to me with a discount on the rent. I wasn't really ready to venture onto my own, but I needed to feel independent, so I took the offer. Within 6 months, I had fallen behind on my car payment, and all of my moving in expenses were put on credit, because I didn't have any money saved up. I'm currently out of that apartment, and staying with my aunt.

Recently receiving calls from Allied Interstate

I've been recently receiving calls from allied interstate for the past month. They verified an acct. that I had with AOL in January 2006! I was never notified by AOL that I even had an acct. [I knew I did I just forgot to cancel, if I had known I was being charged I probably would have remembered]. I decided to dispute the payment with AOL and got payment in December, however Allied Interstate still wants a payment from me! And says AOL will reimburse me when Allied gets payment, which i think is fraud. Is it?

 

2nd Call from Stan Morman from BASS and ASSOCIATES

He just called my place of employment again. I heard the same crap as before. He wouldnt give me any thing in writing and told me that I was going to be "downloaded" for non payment on these accounts. I told him that I have already filed complaints against you and your company and he said he didnt know why there was NOTHING that I could do about! I told him AGAIN to send me validation on the debt and he hung up on me. Now What? phone number was 877-281-2220

 

Harassment by BCR!!!

Bcr has been calling my home with an automated response requesting me to call back. I did finally. It was concerning a debt a fomer live in girlfried has. She hasn't lived with me for 2 years. When I tried to explain, they hung up on me. I called back to speak with a supervisor and they hung up on me as well. For my own satisfaction, I keep returning thier toll free calls, ju6s to run up their bill. 800 lines are expensive. So I have launched my own harassment against them and their time. Little help but it makes me feel better.
