Hello, I filed for Chap. 13 Bankruptcy in May 2009 for 36 months. All payments have been made but the trustee has not stopped the wage garnishment order so now I have overpaid by about $400.00 with more coming out of my check this week. I met with my attorney this past Wednesday who said he would let her know that she has forgotten to stop the wage garnishments and start the process of discharging my case. He alo stated the trustee will refund the overpayment amount back to me. Any idea how long this should take ?

My husbands business closed down due to the bp oil spill in MS. He has outstanding credit card bills due to his advertising and now we are unable to pay on these cards. They call everyday. He has taken on a new job but until he is able to get back on his feet we are unable to send anything at the present. He have considered Bankruptcy but according to your site it is not advisable. Midland Funding LLC has hired a law firm to sue me for a bebt I owed to a credit card company and on public record it says ASSIGNEE OF HSBC. Does that mean Midland Funding is sueing on behalf of HSBC, or does this mean Midland Funding still purchased the debt and it is no longer HSBC?

Hello All I filled a motion to object, Midland Funding levying my Bank Account. The debt they took far supersedes actual debt owed. I owe $200 for charges I made with a hidden fee credit card. I signed up for a CC with a $350 Credit Line, Nowhere did it say they were charging me $150 for $350 credit. I even paid my first balance off in full of $240. It wasn't until I hit my limit the second time, I learned of the $75 yearly membership fee & 1 Time $75 Fee.

I called the first number (886) and it wasn't a valid number, then I tried 866 instead thinking there was a typo somewhere, and then I tried the 866 number and the recording stated the name is resurgent capital services. I don't know if this is the right number because LVNV funding is on my credit report as a LOAN and when I have talked to someone they want to collect a debt for some school I never went to.
