I am caught in a terrrible cycle with payday loans. I need help to get out of this and get my life back on track I need the steps to do it and the laws in Missouri. I just keep making it worse by getting more just to live and pay the others I NEED OUT of it.:sad:

I had a Chase Credit Card and they sold (or assigned) it to a collection agency and later Chase got the debt back somehow and I still dint' have money to settle with them.

Back in 2/2008 I was rushed to the nearest hospital to my home. I had insurance but was out-of-network.(I work for a hospital) I never received bill fro the hopsital or ER Doctor. after 2 months it was turned in to NCO. I contacted OC, about 4-5 months later, asking why I didn't get a bill prior to turning it in to CA. I was told because I had no insurance on file. I gave her my insurance information. Callled back in about a month and was told it was a collet matter, and they couldn't collect due to it being to late. The insurance administrator stated they had a 2year SOL.

Ok, I took out a payday loan and it is due to come out on 5-6-11. I already have the money in there to cover it 260.00 and am faxing a letter Monday for them to take out the full pay off. Other than that is there anything i need to do. I am in a panic over this and should have never taken it out, I had a little emergency. My question is is paying it off on time enough or am I dealing with trouble? I have read a lot of the forums and most seem to come from people not paying on time so I was just double checking my fate, lol!

[COLOR=black]Problem with ER Solution Inc. There is a Sprint bill that my son had in my name in 3/07. It went deliquent in 6/07- 7/07. I paid on it but it went to CA. ER Solutions Inc. are the 2nd CA. since late 2009. Annually they change the Date Open, Date of Status and Last Reported for TransUnion and Experian. Each time it causes my credit score to drop 10-15 points as it looks like a new collection account.

I received collection letter from CA. I sent out a letter of verification and validation of debt. I received the usual letter stating amount owed and original creditor but also there were included copies of all the credit card statements since the opening of the account (24 total). This surprised me because CA's don't have this materials 99.9% of the time. So my question is, In the event of a lawsuit how should I handle the fact that they have these statements prooving the amount that is owed?

I am aware of NJ SOL for credit card accounts is 6 years. But, I found a decission from the court of appeals in NY that states that the sol that applies to credit card debt may be shorter than 6 years, depending on where the credit card issuer is home based. NY has a law stating that the creditor can't take advantage of NY's 6 years sol if the creditor's home state has a shorter sol. So the question is: Is anybody aware of the same law in NJ?

I have an ongoing repayment plan with a creditor (open book account). Payments are up to date and I have a written agreement for the repayment plan. After 5 months of making payments, i got sued by them. What can I do? Is the repayment plan a contract? I can't afford a lump sum payment of the debt. Can I make the repayment plan prevail in court? Does any body know of jurisprudence in a similar matter? Any help is appreciated.
