my "at the time" husband...and i filed chapter 7 in 2007..our attorney would not allow us to reaffirm any of our debts including our home.... a year later my husband left me and the court awarded him the home...he has since walked away from the home...with the mindset that the house was not reaffirmed so there would be no extended loss by walking away...my name is still on the home... i have since been served and apparantly being sued by the mortgage company...is this just the process they have to take or is something wrong here...is my current home in jeopardy of being lost due to this

the collection agency kept asking for extensions and finally my wife got a date incorrect and didnot show this debt was past statute of limitations the judge gave themn a judgment can we still go after the agency on FDCPA violations?

So i fell into the trap! And after reading many post and doing much searching I still really don't have the answer. Here is my situation. I borrowed $250 in return for 325. (i know.. i know..) at any rate in order to pay the loan back you must call 3 days prior to the due date. I did that... twice! both times just the $75 fees were taken and they still want me to pay the the 325. every time i go to set up repayment, there is some reason that they cant set it up at the time.

I have not recieved anything from them, yet the called my parents yesterday 5/21/2010 telling them that I had a lawsuit filed against me and that they were going to take my drivers liscense and the best thing I could do was to contact them immediately. My father told them they needed to call me then and hung up. The man called back and repeated his threats to my mother. Is it not against the law to discuss business with anyone other than the peson involved? ANd how can they still be calling when they are shut down.

Okay, so I received a called about a supposed old debt that I owe from the notorious collection agency, Forster & Garbus last week. Not surprisingly, they were extremely rude and nasty. I sent the DV letter and received the green card back today. What should my next steps be? I've read that at this stage I should now dispute the debt with the credit reporting company. Is this correct? If so, which reporting company do I dispute it with? All of them? Where can I obtain free copies of my credit report from all of them? Just want to ensure I have my ducks lined up properly. Thanks!
