Can anyone tell me if Illinois is a cure state? Does Illinois state laws require written notice of default-right to cure before repossessing a vehicle? Can Wachovia come after us for the difference if the vehicle is sold at auction? Wachovia Dealer Services came and took our vehicle (had a key made) while parked at work. It turns out I have been sending my payments to the wrong address. We have changed banks and my old bank has informed me that digging through old checks for an x customer is not their top priority and will take a couple of months.

I have 4 private student loans taken out through Keybank that total $55,421.77 and these loans are currently in third party collections and have been for probably about 1 month. I did not finish college and currently net about $27k per year. My father cosigned these loans and nets roughly the same amount per year. I have other smaller debts, but no assets.

I Have a tax lien that is killing my score on equifax and transunion. It dropped my transunion score over 150 points. The bad thing about this is i had no idea about it until i pulled my report and saw it,so i called and the lady wrote me a letter and the amount to pay in full and she also said it could be removed from my report after payment was made in full. I done that in july and it was just removed from my transunion report for a whole day. Now its back. I called them and they said they did not accept the letter of removal. Is there anything i can do 2 get this thing removed?

Is there some recourse if an attorney for a debt collector falsifies serving papers by claiming that an individual was served who refused to give their name and no one at the address looks like the description given in the affidavit given by the server?

I was looking over my credit report and there are things still on there that have been paid and things that have moved from one collector to another but the old collector is still on there. Are these things that I can dispute? What can you dispute on a credit report?

First they don't send any letter about any debt. People are only finding out by checking their credit reports. Then they don't respond to validation letter or any other place where complaints can be filed. Now I am reading in another thread about them now suing people. Seriously what is this agency's problem?

I got my first response from them since I sent out letter and demanded refund. It was from "matt" at osm90.com and all it said was your account was sent to National Credit Adjustors..signed i Collect. So please tell me now what he can't even type properly. Thank you!

Does anyone know if there is a particular guideline that trustees follow to determine the value of a car in bankruptcy? I could arguably come up with multiple values for the same automobile, depending whether I use the retail value, the wholesale value, or the auction value....and there may be other values to be considered. Since the means test uses IRS values for determining living expenses, one would think trustees would be required to use IRS methods for determining the value of assets like automobiles, but I don't think that is the case, but I am not sure about it.

Would anyone here be able to tell me how long it takes a company to charge off an account?
