If I file bankruptcy and have exagerrated my income in order to get a credit card, will they credit card debt be discharged? I've heard some say it is considered fraud and others say don't worry about it because the credit companies would never contest it.

Probably a stupid question, but Midland Credit Management called me. I had asked them to send me verification of the debt owed, they sent me stupid non-verifiable amount. Debt owed AND charged off was $2310.00, They say I owe 3741.63. But the paper said they would make $50.00 a month payments on their website.. So I mailed them $50 check (which they still have not cashed to this date) Now they send paper for $50.00 a month with * saying Your credit report will not be updated if federal reporting period has expired.

 

Filing Chapter 7 Pro Se in NJ

I am going to be filing Chapter 7 pro se in NJ (even filing a form to pay the filing fees in installments), and I am pretty clear on all the forms I have to fill out and submit. I am wondering if anyone familiar with this process can throw in their two cents in case there might be anything I have unknowingly missed. Besides owning a used 2000 Toyota Corrolla with no car loan, I have no assets (not even cash on hand!) Thank you!

 

Collection Agency

A collection agency is falsely accussing me of signing a contract. They have a written statement from a person stating she was present when I signed the contract. Supposedly this was in Las Vegas on Nov. 25, 2008. I was not near Las Vegas on that day, I was in Columbus Georgia....working. Can somebody help me on how to write a letter to the collection agency.

 

attorneys in GA

I posted a while ago asking for help in finding an attorney within GA (metro Atlanta would be the best) for assisting with settlement. It was recommended that I pull out the local phone book. So I did that. But, under debt relief/debt settlement attorneys, all I find are BK attorneys. Do BK attorneys do both or will they try and convince me bankruptcy is the best? I am tempted to try settling on my own but we have $140K in credit card debt. We can likely settle in two years but....all the more chance to be sued. thanks..

 

Is this a good Debt Consolidation Deal?

I have about 4500 in CC Debt, spread over 6 accounts. The average APR is 25%. I got the following offer from a Debt Consolidation company: 167/month for 41 months [It includes their $47/month fee]. There are no additional fees and I can cancel / pay off at anytime with no penalties. Just wanted to get some opinions whether I should go ahead with this.

Cashnet USA on credit report

I have a listing on my credit report for a collection agency Allgate Financial for a payday loan from 2006 from Cashnet USA. I had a terrible tim with this payday loan they started debiting my account over and over and early and cost me over $1000 for a $500 loan. I had to close my bank account and they would not work with me just harressed me. They then sent it to collections and it is on all of my CRA reports. Do I have anyway of disputing this? Or is this completely legal of them?

I am hoping I can get some advice. I am currently trying to clean up my credit report. I recently ran a report and have a bunch of old debt/collection agencies on my report. Needless to say a few years ago I hit a rough patch and piled up some debt. I moved a few times and do not have record of these debts from the collection agencies. I realized some of these may be legit and I do want to make arrangements and clear them up. However, I think some seem fishy. I think I understand the process and I am hoping to confirm I am correct.

 

how to determine first delinquent date

How can I determine the first date of delinquency? I have my credit report here in front of me and I have a Collections from Palisades for a Chase card that I had when I was going through a divorce in 1999. Chase is not on my report at all. Am I understanding correctly that 7.5 years after my first delinquency date (as long as it was never made current) this comes off my report? If so, how can I determine this date and get this off? Thanks, Confused
