Hello all, Since the end of January I am STILL getting calls from this idiot. In the past month I have been called about 25 times. For awhile a man by the name of "tom stevens" has called at work and my home. He has told me the same line- I'm going to be arrested if I don't pay- still refuses to send proof of the debt. I have so far ignored the calls. My boss has already filed several complaints. I have. I have also filed a police report as well. Just in this week I have gotten several calls from the same man-THICK accent wanting me to call back at the various numbers below.

I just received a call from Brachfeld Associates. They did not leave a message. In looking them up it seems they must be working with LVNV/Resurgent. I have one collection account they own that used to be a Sears Card. They seem to represent themselves as a law firm but it sounds like they are not from what I have read so far. Anyway, my question is, now that they have called me (as shown by my caller ID), do they have to follow up with a letter indicating I have 30 days for the DV? Any other info on Brachfeld Associates would be appreciated as well.

I have mailed the letters (certified mail) to my four pdl companies. I have closed my bank account. I called the department of banking and finance in my state. All 4 companies have no licence. Now what? When they call I don't plan to talk to them. However when they call work what should my boss say to them to get them not to call (the boss) anymore?

Hello Everyone: I was laid off my job a few months back. My husband's income is barely enough to pay the house note, utilites and phone. I looked into filing bankruptcy but I don't have the money to pay the attorney fees. What options exist for me? I don't think I can use a low income attorney service because my husband income is slightly above the poverty level but all of it is going to maintain our basics (house, utilities, etc.).

I am representing myself in Nebraska in a CC lawsuit against Bank of America. I am in the Discovery process and I have requested validated and verified proof of the debt. I requested this by Certified Mail in October and all the Plaintiff sent me was copies of Credit Card statements which I specifically stated I did not want. My questions is what is the next step on my part?

I live in Texas and due to circumstances beyond my control, I defaulted on a payday loan. They have you make out a check to them and they hold it in case you default. They then try to deposit it and if marked NSF they prosecute or at least that is what they are threatening to do. Can they prosecute for a hot check? Some attorney representing the PDL keeps calling me and has now threatened that if my wife ( not part of loan ) doesn't give him her bank card number and let him set up $200 per month ACH then he will get me for a hot check.

I have been informed by Mann-Bracken that they intend to sue me. I checked with my local courthouse and they have filed a petition and a citation has been issued. The citation was sent to Mann-Bracken so they can serve it themselves when they are ready. I tried to negotiate with them, offering them 30% cash. They refused. I guess I'll wait and see if they serve the citation. I'll use the advice from this, and other, websites to ask for: 1. A full and complete copy of the SIGNED application 2.
