Chosen bankruptcy but afraid of settlement

18 years 9 months ago
I am homeless and own nothing but an old car-1995, and some old clothes, and a few old used dolls, and one diamond ring. I have been unemployed for 5 years. There is no work for me where I live.(I have proof of applying for more than 50 jobs in the last few years.) I was injured in a car wreck 18 months ago and am expecting about $40,000. I need to go bankrupt but am afraid the possibility of getting the settlement will prevent my bankruptcy.I don't know if I am getting this money or not. I just hope so. I owe $40,000 on four credit cards.

Question About Being Destitute

18 years 9 months ago
I have been unemployed for 6 years. I owe on two old credit cards, which now are being collected by debt collection agencies. One account is for $14,000 and the other is for $6000. The SOL is not up for two more years. I have had no income for a long time and I own nothing.(I live with my brother)Can a debt collector see I have no means of paying by looking at my credit report? Should I tell the collectors that I have no means of paying so they do not sue me? Maybe I should file bankruptcy but wait until they get a judgement if they sue.

Palisades Collection - CR states "KD"

18 years 9 months ago
I just checked my credit report and there's a new entry for Palisades Collection. Apperently the account was opened in March of 2005 but I've received no letters/phone calls/information regarding this. There's also no payment history, "ND" listed from March 2005 but all of a sudden there's "KD" in the Jan 07 and Feb 07 months. (Please note this entry was not listed in a credit report that was pulled in July 2005. My credit rating has dropped 60 points!) It looks like this is for an AT&T Wireless charge except I haven't had AT&T wireless since the end of June in 2002.

I Need Help

18 years 9 months ago
I was suckered into purchasing a stereo system for my car. The person told me that he liked the goal i had for my car and said he was going to sponser me free of charge, all i had to was enter my car in a few car shows represent their name. So i agreed and he started ripping borchures apart and telling me where to sign. The guy even set me up for two separate accounts. I looked for a way to fight this but had no luck.

signatures needed on original agreement

18 years 9 months ago
I called a local bankruptcy/credit attorney, in town, today. He says he has been practicing for 32 years. I asked him questions about a debt collector suing and getting a judgement. This is what Mr. Attorney said: A debt collector often buys and sells many debts. They often don't have the original agreement signed by the debtor. In order to get a judgment, the debt collector must have the original agreement, and not just a copy.
