Screwed!!!

15 years 8 months ago
I am a small business owner. I decided to switch banks and open a new business checking account at the same bank my home mortgage is in. I opened it in August 2009 with a branch manager "Paul" who noted on my acct. that all deposits I made would be live and funds available immediately. Today I requested a 30 day acct. history to be printed while making my deposit. I had 29 nsf fees at $33.00 each deducted from my acct. from 5/10/10 to 6/10/10. I sat down to speak with a branch manager who told me "live" deposits had a one day hold and that the original manager Paul no longer worked there.

I have recently used promotional cash advanced checks($10.000) from my credit cards. I have now $40.000 credit card debt. Am I still eligible to do credit card debt settlement?

Debt Reduction Law Center/E. Francisco and Assoc.

I live in Atlanta, GA and hired E. Francisco and Assoc./Debt Reduction Law Center to modify my mortgage. Can I sue this firm ? They are located in California. They told me to stop paying my mortgage and not to worry about it because once they modified the loan the $ owed would be wrapped up into the modification and I would still have a lower monthly payment. I tried dealing with the bank directly but they refused to listen to anything I said. This firm did not have any more success in getting through to my bank than I did myself.

BOA choice of law provision

I'm trying to understand more about the choice of law provisions that are in some cardmember agreements. Does it have to be on the original cardmember agreement or at some point and time later if they added it, can it then be used?

payday loans

15 years 8 months ago
I got myself in trouble with a couple of payday loans. Two I had defaulted on. Both of them I received the loan amount, one for instance, I received 350 in January and they deduct 90 bi-wekly from my account I have now paid about 540 against the loan. I just received a very unprofessional call. This person had a direct line, said his name was Alex. When I asked who he was with he first said he works in a law-office, and that I was being sued, and that I will be arrest on Monday. He read a affidavit to me over the phone. He was foreign, so very hard to understand.

Long story short, I am dealing with a debt collector that's been hounding me for way too long. I have finally gotten to the point where I really have them backed into a corner. when I was first contacted by these clowns, I immediately requested validation and sent a letter disputing the debt. I know they received my validation request letter because they sent me a response letter saying "we have received your dispute". Ever since then, they have called and hounded the daylights out of me. At one point they were calling nineteen times a day.

Dealing with collection agencies

15 years 8 months ago
I have several IPDLs I am working to resolve, all are illegal in my state. I have written the letters and sent them to the companies, but some of them have gone to collection agencies. What's the best way to deal with them? I have already talked to one on the phone who said the letters were a "waste of time" of course and wants me to send a money gram, which I won't do until I get something in writing. Do I just keep ignoring the phone calls? Thanks for all your help so far!

Any way to removed PIF and Settled Accounts from my report?

15 years 8 months ago
I have finally after 5 years become debt free thanks to various articles, posts, and the support of my fiancée. However while I understand that items can be present on a persons report for up to 7 years, I was curious if there was anyway to remove items that have been paid in full or settled for partial payment after a few years. For example a BofA credit card I got at 18 was settled and paid 3 or 4 years ago but still shows. Any advice is greatly appreciated.
