I received a letter from a company (it says negotiating debt is their only business)saying a lawsuit has been filed against me and the sheriff will see me shortly. Is it possible they would know a suit has been filed against me before I would know? I'm pretty sure I read here in the forum that I can call the courts to check if a suit has been filed, is this correct? If this is correct and if the debt is correct, what's the difference of showing up or not if I can't at this time pay the debt off?
I am in AZ, and have a PDL with Apple Fast Cash (14 Day Loan for $200 $48 625.72%) , I was trying to work out an arangements with the several PDL companys and asked if they were liscensed in Arizona,( I found out on this website that they were charging more than AZ allows) this is what I got back from them:
Please be advised that it is our position that the State of Arizona or any of its entities has no jurisdiction over the company’s activities. The company operates under a Delaware Licensed Lender License. All loan applications are received by the company in Delaware.
I am being harassed by collection agencies over debt that was charged off over 5 years ago. How do I let them know that they can't collect due to my states statute of limitations. Can I send them a letter without getting a lawyer. I don't want to do a bankrupty unless I have to.
in 1999 was arrested for driving with susp license, fine was paid by a friend, now a collection agency is pursuing me for payment. because of time, over 8 years, what ismy recourse, does a statute of limitation apply???
So my fiance has a Bank of America card that has been send to NCO collection agency. He has been in contact with them back and forth trying to come up with some kinda of payment arrangement. He lives at home with his parents right now. NCO called his house yesterday and his little brother (11 years old) answered. They told him that if my fiance didn't make a payment today that they were coming to arrest him. I am outraged that they would tell a child this. He was unbelievable scared. Isn't this illegal or something. I told my fiance that he needed to report it to the Attorney General.
