I have been sued in 'small claims' court (in Pennsylvania) for an outstanding credit card debt ($5200.00). Although I have an attorney, I am wondering what to expect at the time. We are hoping the attorney, who has a 200 mile drive, won't show up, but most likely someone local will be there on his behalf. I have been classified as 'judgement proof', meaning I have no property or assets to overtake.

Good morning...well, I've begun to dig out of payday loan debt with the help of AFS, and all the creditors have been cooperative and quiet. BUT...I've tried to work wtih Sonic Payday on my own since they were so aggressive, sent them a cease and desist letter and wage garnish revoke letter, but they contacted my HR department anyway. Luckily my HR rep said she never responds to such companies and not to worry, but did Sonic break the law by not honoring my letters? And what is the correct address for them?

I have evaded collection for about five years. I Started paying creditors off six months ago and suddenly all have caught up with me now at once. I am in a different state and agreed an offer to settle a debit but now want to counter offer. I accepted their offer, signed and noterized agreement to be filed in utah courts in the event I miss a payment. But I am in colorado. The document is a formal doc. to be filed in the state of utah.

Well, one thing I can share with you is that with my current employer, I do delinquent account calls. Here I am in a debt managment program, and I am probably going to end up like some of my clients..... But, what I would like to share with you is that if you see that you are going to be unable to pay your creditors one month, give them a call before they start calling you or sending you letters in the mail. Even if they have started calling you, be sure to keep in contact with them and work things out with them. A majority of them appreciate that.

After going through family problems, 3 choices in education at a University and trying to start a business, I ended up in financial debt of over $84,000. Months ago, I started feeling helpless because my job was not enough to pay everything off, plus there just keeps on being more expenses. I had a loan out with payday-loan-online-to-1000.com aka rio resources. Anyway, I wrote them about the HUGE amount of money that I had paid them already and mentioned that it far exceeded the allowed amount in my state. They wrote me back agreeing to mark my account paid in full and saying that as soon as I faxed in acceptance of their proposal they could process my refund check.

Well, on Friday I officially defaulted on all of my payday loans. The debits did not go through because I changed my account information. Actually ONE did go through after I faxed, mailed and e-mailed the company a letter unauthorizing them to debit my account. Luckily for me, they responded to the request via e-mail and fax threatening to bring charges against me. So I took that information to the bank and filed penalty of perjury complaints against the company. Now I just have to wait for the bank to put my money back into the account. Anybody ever gone through this process?

I live in MI, and on my credit report it states the "Date of last activity" was August 1999, for, this date it is 7 years are these legitimate accounts I can get off my credit report. Thanks
